01. About these terms
These Terms of Service govern your use of clickvoyant.com, our online resources and forms, and the Clickvoyant appointment email and SMS program. “Clickvoyant,” “we,” “us,” and “our” refer to Clickvoyant, based in Colorado.
By using the website, you agree to these terms to the extent permitted by applicable law. If you do not agree, please do not use the website. Website use or acceptance of these terms alone does not enroll you in SMS messaging.
Paid services require a separate agreement. If these website terms conflict with a signed service agreement, that agreement controls for those services.
02. Using the website and forms
Use our website lawfully and provide accurate information when submitting a form or requesting an appointment. You must have authority to provide the information you submit and to act for any business you represent.
Do not misuse the website, submit spam or malicious code, attempt unauthorized access, interfere with its operation, or use our content in a way that violates someone else’s rights. Do not submit confidential client data, sensitive personal information, or login credentials through general inquiry forms.
Submitting a form or booking a discovery call does not by itself create a paid client relationship or guarantee that we can accept an engagement.
03. Resources and intellectual property
Our website content, branding, designs, and resources belong to Clickvoyant or their respective licensors. You may use resources we make available for their stated purpose, including copying prompt-kit prompts into an AI tool for your own business analysis.
Unless a resource includes a different license, you may not resell our materials, claim them as your own, or redistribute them as a competing product without permission. This does not restrict rights granted by applicable law.
Educational content and AI prompts are general information. Recommendations and AI outputs require your review and validation. Results depend on your business, data, implementation, and testing; no specific performance outcome is guaranteed.
04. Email communications
When you request a resource, appointment, or response, we may send related emails, including confirmations, reminders, scheduling updates, and inquiry follow-ups. This appointment program does not include promotional offers.
If you separately subscribe to an educational newsletter, you may unsubscribe using the link in those emails or contact hello@clickvoyant.com. Unsubscribing from a newsletter does not prevent essential communications about a service or request you have made.
05. Appointment and follow-up SMS program
Program: Clickvoyant Appointment & Inquiry Updates. With your opt-in, Clickvoyant sends automated or individual texts about appointments, scheduling changes, reminders, and follow-ups to your inquiries. Promotional offers are excluded.
Consent: SMS consent is optional and separate from email preferences. It is not required to purchase services or submit a form. Providing a phone number alone does not enroll you.
Frequency and cost: Message frequency varies with your appointments and conversations. Message and data rates may apply; ask your carrier about your plan.
Opt out: Reply STOP at any time. You may receive one confirmation, after which program messages stop unless you opt in again.
Rejoin: Complete the SMS opt-in process again to resume messages.
Help: Reply HELP or contact hello@clickvoyant.com.
Delivery: Delivery is not guaranteed. Carriers are not liable for delayed or undelivered messages.
Use a number you are authorized to use and notify us if it changes. Opting out of texts does not cancel an appointment. We administer this program subject to applicable messaging laws and industry requirements. See our Privacy Policy for mobile-data handling.
06. Third-party services
Our website may link to or embed third-party tools, including scheduling, forms, communications, analytics, and AI services. Their own terms and privacy notices also apply to your use of those services. We do not control external websites or guarantee their availability or content.
Our collection and use of personal information is described in our Privacy Policy. These terms do not replace any separate consent required for messaging or data processing.
07. Availability and limitations
To the extent permitted by law, the website and free resources are provided “as is” and “as available,” without warranties of uninterrupted availability, accuracy, or fitness for a particular purpose. We may update, suspend, or discontinue website features.
To the extent permitted by law, Clickvoyant is not liable for indirect, incidental, special, or consequential losses arising from use of the website or free resources. Nothing in these terms excludes liability or limits rights that cannot lawfully be excluded or limited. Any separately contracted services remain subject to their own agreement.
08. Colorado law
Colorado law governs these terms, without applying conflict-of-law rules, except where mandatory law requires otherwise. Any court proceedings concerning these website terms may be brought in a court of competent jurisdiction in Colorado, subject to applicable jurisdiction requirements and non-waivable consumer rights.
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
09. Changes and contact
We may revise these terms and will post the updated version here with a revised date. Changes apply prospectively, subject to any notice or consent required by law.
